Please read these Terms & Conditions carefully before using Aayuvi. By accessing or using the platform, you agree to be bound by the terms set out below.
AAYUVI END-USER LICENSE AGREEMENT
This End User License Agreement ("EULA") is a legal agreement between you ("you" and/or "your") and Aayuvi ("Company") for your use of the Company's Patient Enablement Portal and Unified PHR solution ("Aayuvi") and its associated services ("Services"). These Services include: (i) the personal health record management software integrated with the Ayushman Bharat Digital Mission (ABDM); and (ii) any health-related content, reports, or data made available to you through the Services ("Content").
BY USING THE SERVICES, YOU ACCEPT THE TERMS AND CONDITIONS OF THIS EULA. IF YOU DO NOT ACCEPT THESE TERMS, DO NOT USE THE SERVICES.
1.1 By subscribing to Aayuvi or creating an account via your ABHA ID, you acknowledge that you have read, understood, and consent to be bound by this EULA.
1.2 This EULA is an electronic record generated under the Information Technology Act, 2000, and is published in accordance with the Information Technology (Intermediaries Guidelines) Rules, 2021. No physical signature is required.
1.3 This EULA governs your use of the Aayuvi Patient Enablement and Healthcare Management Portal, which serves as a secure gateway to view, manage, and control your health data.
2.1 Aayuvi is a subscription-based solution. You agree to pay the charges for the Services as applicable to you.
2.2 Payments must be made via authorized channels provided by the Company. Applicable charges are subject to periodic review at the Company's sole discretion.
2.3 Aayuvi is not liable for any payment issues arising from third-party gateway failures or unauthorized transactions.
3.1 Aayuvi grants you a limited, non-exclusive, non-transferable right to access the Services to manage your healthcare records such as prescriptions and diagnostic reports.
3.2 This license allows you to use the Document Manager to centralize records, request your healthcare data from healthcare providers, and use the Consent Management system to share data with healthcare providers.
4.1 The Company and its licensors own all titles, copyrights, and intellectual property rights in the Aayuvi platform.
4.2 The Services are licensed, not sold. You do not acquire any ownership rights by using the portal.
5.1 Aayuvi operates on a consent-driven data exchange model. You have the sole right to grant, deny, or revoke access to your health records for any doctor, clinic, or third party.
5.2 You may set preferences for automatic data sharing, but you remain responsible for your selections, including who views your information and for what purpose.
5.3 Integration with the ABHA system ensures your health identity is unified across the platform while maintaining strict privacy standards.
6.1 Aayuvi facilitates the aggregation of health records from hospitals, labs, and pharmacies into a unified profile and is not responsible for the timeliness of response by HIPs, or the quality or accuracy of data.
6.2 While Aayuvi provides the platform for visibility and access, the accuracy of medical data remains the responsibility of the Health Information Providers (HIPs).
6.3 Use of the Aayuvi Health Locker for storing and retrieving documents is at your discretion.
7.1 You may not reverse engineer, decompile, or attempt to discover the source code of the Aayuvi platform.
7.2 You may not use the Services for any unlawful purpose or to upload content that infringes on third-party intellectual property or privacy rights.
7.3 You may not use the Services for any unlawful activity or purpose.
8.1 This EULA is effective until terminated. The Company may suspend your access if you fail to comply with these terms.
8.2 Upon termination, you must cease all use of the Services. However, your records stored within the ABDM ecosystem may remain accessible via other ABDM-compliant PHR apps as per Government of India regulations.
9.1 You are responsible for maintaining the confidentiality of your login credentials, including ABHA-based authentication.
9.2 You shall not interfere with the proper working of the Aayuvi infrastructure or bypass any security measures used to restrict access.
9.3 Prohibited activities include using robots for data mining or attempting to gain unauthorized access to other users' health accounts.
10.1 Aayuvi reserves the right to modify these terms or the features of the Services (such as adding upcoming phases like Wellness Modules or Insurance Integration) at any time. Significant changes will be updated online.
11.1 ABHA Linking: You explicitly authorize Aayuvi to link your personal health records to your Ayushman Bharat Health Account (ABHA) address and number.
11.2 Federated Data Architecture: You acknowledge that Aayuvi acts as a gateway and "Health Information User" (HIU); while Aayuvi provides visibility, your medical records are stored in a decentralized manner by the respective Health Information Providers (HIPs), such as hospitals or labs.
11.3 Authentication: You authorize the use of ABHA-based authentication for secure onboarding and to enable a unified health identity across the national digital health network.
12.1 No Medical Advice: Aayuvi is a technology platform for record management and does not provide medical advice, clinical diagnosis, or professional treatment.
12.2 Emergency Disclaimer: The Services are not for emergency use. In the event of a medical emergency, you must contact professional emergency services or visit a hospital directly.
12.3 Data Accuracy: The accuracy and clinical validity of medical data remains the sole responsibility of the generating HIP; Aayuvi is not liable for errors in records shared directly by healthcare facilities.
13.1 Granular Control: You have the right to provide consent for specific record types or time ranges rather than sharing your entire medical history.
13.2 Revocation: You may revoke access granted to any doctor, clinic, or third party at any time through the Aayuvi portal; however, data already accessed by a provider prior to revocation cannot be retrieved.
13.3 Transparency: You have the right to view a log of who has accessed or requested your data through the Consent Management module.
14.1 Health Locker Security: Documents stored in your Health Locker are protected by encrypted backups to maintain data security and privacy.
14.2 Data Fiduciary Standards: Aayuvi adheres to patient-centric digital health record standards, ensuring that data sharing is strictly driven by your explicit approval.
14.3 Right to Erasure: You may request account deletion, subject to statutory retention requirements mandated by Indian law for medical recordkeeping.
15.1 Record Verification: You are responsible for reviewing the consolidated health information on your Unified Patient Dashboard and reporting any discrepancies to the original provider.
15.2 Device Security: You must ensure that the mobile device or web browser used to access Aayuvi is secure to prevent unauthorized access to sensitive medical information.
15.3 Interoperability: You acknowledge your right to share health records via secure links or direct access with other ABDM-compliant entities for continuity of care.
